Preemption of state laws

  • Undermining State Legal Authority to Protect the Environment
    Project Description:
    "No more stringent" legislation. This research project would include a review of proposed/enacted legislation at the state level that prevents the state government from passing legislation that is more stringent than federal law. The researcher would identify trends in "no more stringent" laws--ie, whether they tend to pertain to specific issues or correspond with growing pressure at the state level to regulate industry. The researcher also would contact state level officials in these states to discuss this legislation and identify the key proponents of "no more stringent" legislation is.
